Firm Prevails in Second Circuit Trade Dress Infringement Appeal

On Thursday, the Second Circuit vacated the District Court’s dismissal of our client’s claims and remanded for further proceedings. Daniel Woofter argued the case of The Wonderful Company LLC v. Nut Cravings Inc. early last month. The Court of Appeals agreed that our clients—The Wonderful Company LLC and Cal Pure Produce Inc.—had adequately alleged both the likelihood of consumer confusion between the parties’ competing pistachio packaging and the non-functional nature of our clients’ distinctive trade dress. The decision allows our clients to continue protecting their valuable brand identity from infringers who seek to profit off their hard-earned customer goodwill.
