Firms Files Merits Brief in Supreme Court in Climate Change Case.

Today, the firm filed a brief in the Supreme Court on behalf of the City and County of Boulder, Colorado in a case testing whether states can hold fossil fuel companies responsible for their role in global climate change. The Supreme Court took the case to decide whether federal law preempts state tort claims alleging that fossil fuel companies deceived the public about the effects of their products on the climate and created a public nuisance under state tort law. The Court also ordered briefing on two jurisdictional questions to decide whether it could hear the case in the first place. Kevin will argue the case on behalf of the Boulder plaintiffs in the fall.
