Kevin Russell Argues on behalf of Colorado Local Governments in Supreme Court Climate Change Case

Earlier this week, Kevin Russell presented oral argument in the Supreme Court on behalf of the city and county of Boulder, Colorado in a closely watched case about fossil fuel companies’ liability for their contribution to harms arising from climate change. The local governments charge that the defendants, Exxon and Suncor, are liable for deceptive marketing that misled the country regarding the climate consequences of their products. The Supreme Court will be deciding whether those state law claims are preempted by the Clean Air Act or by principles implicit in the Constitution’s structure.
