Firm Files Cert. Petition in Wetlands Dispute

Last week, Russell & Woofter filed a cert. petition asking the Supreme Court to decide whether companies that fill in wetlands under Clean Water Act permits can later avoid citizen suits alleging violations of those permits by claiming that the wetlands were not protected by the Act—despite having waived “any challenge to such jurisdiction . . . in any Federal Court” in applying for the permit.
